Fiqh Al Nawazul

Fiqh Al Nawazul is the jurisprudence of emerging issues for which there is no explicit text in the Qur’an or Sunnah, and which arise in Muslim society as a result of developments in modern life in various fields such as technology, economics, politics, and others.
 
It is considered one of the broadest areas of jurisprudential ijtihad, as it relies on deriving Sharia rulings through jurisprudential tools such as analogy, preference, public interest, and Sharia objectives, to find practical solutions to emerging problems.
 
One of the most important characteristics of the jurisprudence of new issues is that it deals with contemporary challenges and keeps pace with the changes of the era while preserving the constants of Islamic law.
 
It requires jurists and scholars of Sharia to have a deep understanding of the reality of emerging society and the ability to balance people’s interests with the teachings of Islam.
 
Fiqh Al Nawazul also includes topics such as Islamic finance, modern banking transactions, medicine and medical sciences, and other issues that did not exist in previous Islamic eras.
 
This type of jurisprudence requires jurisprudential flexibility and contributes to providing contemporary Sharia answers that meet the needs of Muslim society while taking into account preserving the objectives of Sharia in achieving justice and preserving rights.
